2. Definitions

• “Services” means any hosting, infrastructure, or related services we provide.
• “You” / “Customer” means the person or entity that has an account or uses our Services.
• “Content” means any data, software, or materials you store, transmit, or process using our Services.
• “AUP” means our Acceptable Use Policy, which is part of these Terms.

3. Account & Registration

You must provide accurate, current registration information and keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized use. You must be at least 18 years old (or the age of majority in your jurisdiction) to use our Services. We may suspend or terminate accounts that provide false information or are used in violation of these Terms.

4. Acceptable Use Policy

You agree to use our Services only for lawful purposes and in accordance with this AUP. You may not use our Services to:

• Violate any applicable law, regulation, or third-party rights.
• Distribute malware, viruses, or other harmful code.
• Send unsolicited bulk email (spam), phishing, or run mail servers that facilitate spam.
• Conduct denial-of-service (DoS/DDoS) attacks, network scanning, or unauthorized access to systems or networks.
• Host, distribute, or link to illegal content (e.g. child sexual abuse material, fraud, stolen data).
• Infringe intellectual property rights, including copyright and trademark.
• Resell or sublease our Services without prior written agreement, except as permitted by your plan.
• Use excessive resources in a way that negatively impacts other customers or our infrastructure (e.g. on shared systems).
• Run cryptocurrency mining or other high-intensity workloads on plans not designated for such use, if we have notified you of such restrictions.

We may investigate suspected violations and, at our discretion, suspend or terminate Services, remove Content, and report activity to authorities. We are not obligated to monitor Content but may do so to enforce this AUP and protect our network and users.

5. Payment & Billing

Fees for Services are as stated at the time of order or in your client area. You agree to pay all fees when due. Recurring fees (e.g. monthly) are billed in advance. Failure to pay may result in suspension or termination of Services and possible data loss. We may change pricing with reasonable notice; continued use after the effective date constitutes acceptance. Refunds are subject to our refund policy as stated at purchase or in the client area; we do not guarantee refunds for partial periods or one-time fees unless otherwise stated. Chargebacks or payment disputes may result in account suspension and collection action.

6. Suspension & Termination

We may suspend or terminate your access to Services immediately, without prior notice, for violation of these Terms or the AUP, non-payment, or to protect our network and other customers. You may cancel Services in accordance with the process in your client area. Upon termination, your right to use the Services ceases. We may delete Content and data after a reasonable grace period; you are responsible for backing up your data. Provisions that by their nature should survive (e.g. liability limits, indemnification) will survive termination.

7. Limitation of Liability

To the maximum extent permitted by law, Oneraap Hosting and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of data, revenue, or profit) arising from or related to the Services or these Terms, even if advised of the possibility of such damages. Our total liability for any claim arising from or related to the Services or these Terms shall not exceed the amount you paid us for the Services in the twelve (12) months preceding the claim. Some jurisdictions do not allow limitation of liability for certain damages; in such cases, our liability is limited to the fullest extent permitted by law.

8. DMCA & Copyright

We respect intellectual property rights and respond to valid notices under the Digital Millennium Copyright Act (DMCA) and similar laws. If you believe Content on our network infringes your copyright, send a written DMCA notice to our designated agent (contact details below) including: your contact information, identification of the copyrighted work, identification of the infringing material and its location, a statement of good faith belief, a statement of accuracy under penalty of perjury, and your physical or electronic signature. We may remove or disable access to allegedly infringing material and terminate repeat infringers. Counter-notification procedures are available under the DMCA. 9. Changes to Terms

We may update these Terms from time to time. We will post the updated Terms on our website and may notify you by email or through your client area. The “Last updated” date at the top reflects the effective date. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Services and may cancel your account.
